Yevamos 55b - Gmar Biah for Yevama

Tosafos raises a contradiction between the gemara in kiddushin which implies that ha'arah does not work as biah for kiddushin, and in yevamos it says that it does work. Tosafos says that if he does only ha'arah then it works, but if he does a g'mar biah then he is only koneh at the completion of the biah since his da'as is on the g'mar biah. The Nemukei Yosef here and Ran in Kiddushin (brought in Beis Shmuel 166:6) writes that by a yevama even if his mind is on g'mar biah, he is already koneh at the time of ha'arah since his intent is not rellevant bec. even if they are both anusim he is koneh her.
However, Tosafos Yeshanim asks How can the gemara discuss whether the positive mitzvah of yibum will push off the issur of a widow to kohen gadol, the issur is violated at the time of ha'arah, yet the mitzvah of yibum is not performed until the g'mar biah, so it is not b'idnah. This question can be answered in many different ways. My point is to focus on the assumption of the question that yevama is only acquired with g'mar biah. It seems to me that the Tosafos Yeshanim understands that since the simple reading of the Torah "lehakim sheim" implies g'mar biah, we assume that a person who does a g'mar biah will have in mind to be koneh only with g'mar biah, and would not be koneh with ha'arah. Clearly, this is against the Ran and Nimukei Yosef, but the question is: Since da'as in not a factor, he should be koneh with ha'arah even if his mind is on g'mar biah (which is the proof of the Ran and Nimukei Yosef)?
Perhaps the chiddush of being koneh even o'nes is limited to a situation where he did not have intent to be koneh. But if he had explicit intent NOT to be koneh his yevama with biah, he would not be koneh her (i am not sure if this is true - any proofs for or against?). Therefore, when he does a g'mar biah the Tosafos Yeshanim understands that it is as if he has explicit intent to be koneh with g'mar biah and NOT ha'arah. That is why they assume that you are not koneh with ha'arah (not like the Ran and Nimukei Yosef).

Where is this תו"י? I don't understand, the gemara explicitly says that a יבמה is acquired with העראה? Doesn’t it?

The Tosafos Yeshanim is on 55b. I understand that the gemara says explicitly that ha'arah works by yevama. The gemara says the same by an isha who is mikudeshes with biah, yet tosafos explains that it is limited to a case where he is poreish after ha'arah, but if he does a g'mar biah then he is not koneh by the ha'arah (nafka minah if she is pashta yada - but practically would be a bit awkward). Tosafos yeshanim understands that by yevama we would make the same distinction, she is only acquired with ha'arah if he is poresh right after ha'arah.
Anyway, do you have any proof one way or the other whether he is koneh her, if he has explicit da'as not to be koneh her [we checked the minchas chinuch, the only thing we found similar is a discussion about when he does yibum b'ones acc. to the opinion that mitzvos need kavana, maybe he is koneh her, but did not fulfill the mitzvah).

אמר לי חד והסכמתי דביאת מזיד דהיינו לשם זנות הוי כעין שלא לקנות ועדיין נקנית, וכן מוכח מהסוגיא נ"ח דהגמרא לא מוצאת ציור שנבעלה ליבם ולא נקנית
ולכן פשט שתו"י צריך להיות שכשיש גמר ביאה אז תחילת ביאה לא קונה לא משום שאין זה דעתו אלא שזה דין בביאה עצמה
באופן, שחשיבות ביאה הוי בעצם בסופה וזהו הקונה אלא שכשאדם עושה רק תחילת ביאה א"כ זהו כבר חשוב, והבוחר יבחר

ישר כחך על הראיה מהגמ' נח: עיינתי שם וראיתי שבגליון הגמ' שלי ציינתי לח' רע"א נג: שהיה לו משא ומתן עם בנו בנדון זה אם אומר במפורש שאינו רוצה לקנות, אם קונה אותה בעל כרחו ע"י המעשה ביאה. בנו הגאון רצה לתלות זה בפלוגתא, ורצה לדייק מנמוק"י שהבאתי דדוקא כשאין דעתו לקנות עד גמר ביאה אינו מועיל כוונתו, משמע דאם דעתו במפורש שלא לקנותה כלל, אינו קונה אותה להיות יבמתו

אך, הגרע"א דחה דבריו בב' ידים "דאם איתא דבעל כרחו אינו קונה, גם באומר שאינו רוצה עד גמר ביאה לא נקני בהעראה, כיון דעד שעת גמר ביאה אין רצוני לקנותה, ומה לי שאינו רוצה לקנותה כלל או שאינו רוצה לקנותה עד אחר זמן". מ"מ מדברי הגרע"א למדנו סברא לפרש דעת התוס' ישנים הנ"ל, דעיקר חידושו של הנמוק"י הוא "דלא נימא כמו דבאשה דעלמא דהעראה קונה ומ"מ בסתם דעתו על גמר ביאה, והיה מקום לומר דגם ביבמה אף דלא בעינן דעתו, מ"מ יש לומר דהעראה דהוי ביאה גרועה לא מחשבה ביאה אלא באחשבה לקנותה על ידה, אבל בלא אחשבה אין עליה שם ביאה כלל". הרי מבואר מדברי הגרע"א דסברת דעת החולקים על הנמוק"י הוא דהא דמהני העראה במקום ביאה היינו דוקא היכא דאחשביה במה שפירש מיד אחר העראה, אבל כשגמר ביאתו ולא אחשביה העראה, אינו קונה אותה עד גמר ביאה.והביא מהריטב"א בקדושין עז דשייך חילוק התוס' אף במעשה עבירה, דכל שגמר ביאתו אינו חייב משעת העראה. ולפום ריהטא אינו מובן כלל דבמעשה עבירה לא שייך כל הענין של "דעתו על גמר ביאה" דמה בכך הא משעת העראה כבר עבר איסורא. א"ו דדוקא היכא דאחשביה ההעראה דינו כביאה גמורה

נמצא שהנמוק"י חולק על סברא זו, ומ"מ הרווחנו בזה ליישב דברי התו"י. ומסיק הגרע"א להביא ראיה מהגמ' שהבאת בדף נח: וז"ל ונ"ל ראיה לזה דקונה בעל כרחו דידיה מסוגיא דיבמות נח: דכוותה גבי שמורת יבם וכו' והא"ר קנה לכל, ואמאי לא מקוי ליה בבא עליה היבם ופירש שאינו רוצה לקנותה, ע"כ שגם בזה קנאה עכ"ל. הרי כוונת לראייתו של הגרע"א
