עבדים בחיוב מגילה

עיין בשו"ע דרק עבדים משוחררים חייבים במגילה אך המ"ב מביא מ"ח שיש שמחייבים עבדים ממש

ולכאורה תלוי בהבנת אף הם היו בנס דלרש"י שגם הנשים ניצלו מהגזירה לכאורה זה גם שיים לעבדים אך לרשב"ם שהם היו עיקר הנס שפעלו הנס לכאורה זה ל"ש בעבדים. ושמעתי שהגרי"ז חקר אם אף הם היו בהנס זה חיוב חדש או רק מוריד את הפטור של זמן גרמא ונפ"מ לעבדים שאם זה חיוב חדש ל"ש לעבדים ואם כצד השני עבדים יהיו מחוייבים. ונ"ל שכל הספק רק שייך לרשב"ם אך לרש"י בפשטות גם עבדים יחויבו. וצ"ע ולא ראיתי הגדי"ז בעצמי

whether af hein hayu b'oso haneis is considered a new chiyuv or not would be dependent on tosafos in pesachim (108b - i think). Tosafos writes that af hein hayu only applies to a mitzvah d'oraysa, not to a mitzvah drabonon (different from tosafos in megillah 4a that it applies to a mitzvah d'oraysa but only on a d'rabonon level). The pshat in tosafos is that af hein hayu can extend the takana while it is being instituted, to women also. but on a preexisting mitzvah d'oraysa, it can't me mechadesh a new chiyuv on women.

we recently had r' nota greenblatt in palo alto. he raised a question why we assume that women are patur from hallel on chanuka - we should say af hein hayu... like we find by hallel on pesach (tosafos succah 38a - i think)?
i wanted to answer based on rashi at the end of ta'anis that hallel on chanuka is like a d'oraysa (not like rosh chodesh). the peshat is like rashi explains the nevi'im rishonim were mesaken that on every neis, we say hallel, therefore the takana of hallel on chanuka was not a takana that took place bzman haneis. rather, it is an old takana from nevi'im rishonim and like a d'oraysa. therefore, based on tosafos in pesachim we can't be mechadesh a new chiyuv on women based on af hein hayu... but the lighting of candles which was an intstitution in the time of chanuka can be extended to women based on af hein hayu.
